Legislators approve Law on Justice for Minors
VGP – The National Assembly approved the Law on Justice for Minors at its 8th working session in Ha Noi on Saturday morning.
The law, comprising 10 chapters and 179 articles, shall come into effect on January 1, 2025.
The law is designed to protect the rights and best interests of minors. It aims to ensure that the handling of juvenile offenders is appropriate to their age, cognitive ability, personal circumstances, and the societal danger posed by their actions.
The law focuses on educating and rehabilitating young offenders to help them correct their mistakes, improve their behaviour, and become productive members of society.
It outlines measures for diversion, penalties, and legal procedures for juvenile offenders. It also addresses procedures for victims and witnesses, execution of sentences, reintegration into the community, and support for victims. It specifies the roles, duties, and responsibilities of organisations and individuals involved in juvenile justice.
Particularly, the law specifies diversion measures, which include reprimands restricted hours for activities and movement, apologies to victims, compensation for damage, participation in educational or vocational programmes, mandatory psychological treatment or counselling, and community service.
Under the newly adopted law, minors eligible for diversion include those aged 16 to under 18 who commit minor or serious offences, those aged 14 to under 16 who commit very serious offences (excluding specified crimes under Article 123 of the Penal Code), and minors with minimal roles in group offences.
The same day, the legislative body also passed a Resolution on the establishment of centrally-run Hue city covering the whole natural area of Thua Thien Hue province. The Resolution is scheduled to come into effect from January 1, 2025.
At present, Thua Thien Hue province has total area of 4,947,11 km2 and a population of 1,236,393.
The establishment of centrally-run Hue city will be the basis for the central Government and local administration to deploy urban development programs.
With this move, Viet Nam will have six centrally-run cities namely: Ha Noi, Ho Chi Minh City, Hai Phong, Da Nang, Hue and Can Tho.
Earlier on Friday, the National Assembly adopted the Law on amendments and supplementations to a number of articles of nine laws on November 29 as part of its ongoing eighth session.
The nine legal documents are the Law on Securities, Accounting Law, Law on Independent Audit, State Budget Law, Law on Management and Use of Public Assets, Tax Management Law, Law on Personal Income Tax, Law on the National Reserves, and Law on Handling of Administrative Violations./.
