Major takeaways from Viet Nam's Law on International Treaties

Principles for signing and implementation of international treaties:

1. Not to be contrary to the Constitution of the Socialist Republic of Viet Nam

2. To respect national independence, sovereignty, and territorial integrity, to refrain from using or threatening to use force, or interfering into each other's internal affairs, to ensure equality and mutual benefits as well as other fundamental principles of international law.

3. To ensure national interests, and to conform with the foreign policy of the Socialist Republic of Viet Nam.

4. To comply with the international treaty to which Viet Nam is a signatory.

Competence to decide on negotiation of a treaty:

1. The President of the Socialist Republic of Viet Nam shall decide on, authorize, advocate and conclude the negotiation of an international treaty in the name of the State.

2. The Prime Minister of the Socialist Republic of Viet Nam shall decide on, authorize, advocate and conclude the negotiation of an international treaty in the name of the Government.

International treaties subject to ratification:

1. An international treaty that contains ratification provisions

2. An international treaty in the name of the State.

3. An international treaty in the name of the Government which contains provisions contrary to a lw or a resolution of the National Assembly.

Ratification competence of the National Assembly:

The National Assembly shall ratify the following international treaties:

a) An international treaty on war, peace, national sovereignty of the Socialist Republic of Viet Nam

b) An international treaty on the establishment of, or participation in a regional and international organization if the establishment of, participation in, or withdrawal from such organzation affects national fundamental policies on foreign affairs, defense, security, socio-economic development, and financial and monetary policies.

c) An international treaty that may result in change, restriction, or termination of human rights, fundamental rights and obligations of citizens as prescribed by a law or resolution of the National Assembly.

d) An international treaty that contains provisions contrary to a law or resolution of the National Assembly.

dd) An international treaty directly signed by the President of the Socialist Republic of Viet Nam with the Head of another State.
