Administrative sanctions against violations in crypto assets
VGP – The Government has promulgated Decree No. 284/2026/ND-CP on administrative sanctioning of violations in the field of crypto assets.
Under the Decree, the maximum fine for a violation shall be VND200,000,000 for an organization and VND100,000,000 for an individual
A fine between VND70,000,000 and VND100,000,000 shall be imposed on crypto asset issuers that violate legal provisions on foreign ownership ratio.
A fine between VND100,000,000 and VND150,000,000 shall be imposed on crypto asset issuers that provide inaccurate, incomplete, or untimely information, causing misunderstandings for state regulatory authorities, crypto asset service providers, or investors.
A fine between VND150,000,000 and VND200,000,000 shall be imposed on crypto asset issuers commiting one of the following vilations:
Offering or issuing crypto assets to ineligible entities; Offering or issuing crypto assets without satisfying all conditions as prescribed under Article 5 of Resolution No. 05/2025/NQ-CP of the Government; Failing to disclose information in the offering/issuance prospectus and other relevant documents on the website of the crypto asset service provider and the website of the issuer as prescribed in Clause 3, Article 6 of Resolution No. 05/2025/NQ-CP of the Government; Failing to comply with the information disclosed in the offering/issuance prospectus.
The Decree also specifies that a fine between VND180,000,000 and VND200,000,000 shall be imposed on one of the following violations:
Providing services related to crypto assets without a license; Advertising or marketing related to crypto assets without a license
In addition, the Decree also stipulates a fine ranging from VND50,000,000 to VND70,000,000 for crypto asset service providers that fail to verify the identity of investors opening accounts.
A fine ranging from VND 150,000,000 to VND 200,000,000 shall be imposed for unlawfully collecting, storing, exchanging, buying, selling, donating, or disclosing data and information related to crypto asset accounts.
The Decree No. 284/2026/ND-CP shall take effect from September 1, 2026, until the date Resolution No. 05/2025/NQ-CP ceases to be effective.
