Presidential office announces three new laws

VGP – The Office of State President on Tuesday announced three new laws, namely the Law on Public Servants, the Law on Minerals (amended), and the Law on Consumer Protection, which all were approved by the NA’s recent plenary session.

Enhancing capacity of State agencies

The Law on Public Servants is expected to strengthen the capacity of the State agencies

By the end of 2009, the total number of Vietnamese public servants was 1,657,470 (excluding those working in the State’s profit-making bodies).

The Law on Public Servants is expected to raise public servants’ capacity and contributions to their performance.

The Law will come into effect since January 1, 2012.

More effective consumer protection

The Law on Consumer Protection was approved at the time when the rate of cases violating consumers’ interests is increasing, said Deputy Minister of Industry and Trade Lê Danh Vĩnh.

Deceptive activities against consumers can be easily found, especially in terms of measurement and the provision of goods and services during the past time, due to the shortage of legal regulations on settling consumers’ complaints and accusations.

Under the law, disputes between providers of goods or services and consumers will be resolved through negotiation, mediation, arbitration, or by courts.

In case individuals or organizations cause damages to the State, consumers, and the community, the aggrieved party can directly send a written requirement to the district-level State agency on consumer protection for judgment.

The Law also stipulates the rights of social organizations to protect consumers’ interests and to sue offenders.

The law will come into effect on July 1, 2011.

Expanding State management over minerals

The Law on Mineral Resources, scheduled to take effect since July 1, 2011, is expected to raise the State management over minerals in line with administrative reforms.

The licenses for mineral exploitation will be granted through auction, says the law.

Conditions and principles for granting licenses are also clearly stipulated in the Law to sort out best individuals and organizations for the exploration of resources.
