Permitted jobs for labor outsourcing

VGP - The Government on March 20 issued Decree No. 29/2019/ND-CP (“Decree 29”) detailing and guiding the implementation of Article 58 of the Labor Code on licensing labor outsourcing activities, payment of escrow deposits and the list of jobs in which labor outsourcing is allowed.

Question: How long is a labor outsourcing license last?

Which jobs are allowed for labor outsourcing?

Answer:

Decree 29 extends the term and not limiting the number of times to renew labor outsourcing licenses.

Pursuant to the new provisions, the term of a labor outsourcing license is up to 60 months instead of 36 months as before.

Also, pursuant to Decree 29, the renewal of labor outsourcing licenses can be granted many times and the maximum period of a renewal is 60 months instead of 02 times and 24 months.

In addition to the list of 17 jobs that can be outsourced, Decree 29 supplements three jobs to this list, specifically:  (1) Management, operation, maintenance and providing services on seagoing vessels; (2) Management, supervision, operation, repair, maintenance and providing services on oil rigs; and (3) Flying aircrafts, serving on aircrafts/maintaining, repairing aircrafts and aircraft equipment/moderation and exploitation of flights/ supervision of flights.

Decree 29 came into force from May 5, 2019./.
